GENERAL TERMS & CONDITIONS OF SALE (GTC)

§ 1  Scope and Applicability

(1)  These General Terms and Conditions (GTC) apply to any air transport contracts concluded by AIR UNIQON GmbH (“AIR UNIQON”), Dorfstraße 11, 16835 Rüthnick. They shall apply irrespective of the carrier that actually performs the contractual carriage service on behalf of AIR UNIQON.

(2)  These GTC also apply to contracts concluded by AIR UNIQON for additional services, such as seat reservations, the booking of sports or special baggage, in-flight sales, as well as any other contracts that refer to these GTC.

(3)  In addition to these GTC, the General Conditions of Carriage for Passengers and Baggage (GCC) of AIR UNIQON shall also apply.

§ 2  Air Fare and Payment

(1)  The services and total fare confirmed at the time of booking shall apply. The total fare refers to the fare for the flight plus taxes, fees, and any applicable service charges. Fares include the cost of transportation only and do not include service charges, taxes, fees, or other aviation-specific charges.

(2)  The total fare is due in full at the time of booking. Partial payments are not permitted and will be rejected by AIR UNIQON. Any credit resulting from such rejection will first be applied against any outstanding claims of AIR UNIQON, with any remaining balance subsequently refunded. Any partial payments made toward an existing claim will be applied first to the oldest outstanding claim. A payment that is insufficient to fully settle the claim will be applied first to interest and thereafter to the total fare.

(3)  If payment is made by credit card, the card will be charged immediately upon booking and the travel documents will be sent simultaneously. If the payment method “bank transfer” is selected, the total fare must be transferred immediately; payment must be received in full by AIR UNIQON no later than 5 days after booking.

(4)  If the total fare has not been paid in full within 5 days after booking, AIR UNIQON shall be entitled to terminate the air transport contract and cancel the booking, and to claim compensation in accordance with the cancellation conditions of the selected fare, if and to the extent that:

(a)  AIR UNIQON has unsuccessfully issued a reminder for payment after the due date and prior to cancellation. A reminder is considered equivalent to filing a lawsuit or applying for a payment order;

(b)  a specific calendar date for payment was agreed in the air transport contract and payment has not been received in full by that date. In this case, a reminder by AIR UNIQON is not required;

(c)  the air transport contract stipulates that payment is to be made after a certain event and within a reasonable period following that event, so that the payment date can be calculated from the event according to the calendar, and payment has not been received in full by that date. In this case, a reminder by AIR UNIQON is not required;

(d)  payment has been seriously and definitively refused. This may be expressed explicitly in a declaration to AIR UNIQON or to a third party through whom the booking was made, or implied, e.g., by a chargeback, failure to authorize a credit card charge, or similar. It is irrelevant whether the chargeback/failure to authorize results from an explicit request or from insufficient funds in the account. In this case, a reminder by AIR UNIQON is not required;

(e)  considering the interests of both parties, immediate default is justified. Such a case exists in particular if departure is imminent and therefore setting a deadline prior to departure is no longer feasible. In this case, a reminder is not required, and AIR UNIQON may immediately terminate the contract, refuse carriage, and claim damages.

(5)  The right of termination shall not apply if it can be demonstrated that AIR UNIQON is solely or predominantly responsible for the non-payment or late payment.

(6)  In the event of a cancellation, AIR UNIQON shall have no further obligation to provide carriage.

(7)  In the event of non-payment or late payment (default), AIR UNIQON shall be entitled to charge default interest at the statutory rate. Other rights and claims of AIR UNIQON arising from the default shall remain unaffected.

(8)  In the event of a chargeback or credit card reversal for which the passenger is responsible (e.g., due to incorrect information or insufficient funds), AIR UNIQON shall be entitled to charge a fee of EUR 15 per booking. If the chargeback results in the claim (e.g., payment of the total fare) being settled only at the airport, the fee shall amount to EUR 30 per booking.

(9)  In the event of a chargeback for which the passenger is responsible, AIR UNIQON shall also be entitled to collect the resulting outstanding claim, including the above-mentioned fee, again via SEPA direct debit. In this regard, the SEPA direct debit mandate granted by the passenger also applies to claims arising from chargebacks due to insufficient funds and any associated compensation claims. AIR UNIQON is entitled to engage a third party to collect SEPA direct debits.

(10)  The passenger is free to demonstrate that AIR UNIQON has incurred a lesser or no damage in the individual case. If successful, only the lesser damage shall be compensated.

§ 3  Seats and Additional Services

(1)  For passengers in Business Class and Premium Economy Class (Smart), seat reservations are included and, if available, offered at no additional charge. In the event of a change of aircraft type, a seat reservation may not be accommodated.

(2)  Seats may be reserved subject to availability. After the commencement of the first flight segment, any fees for seat reservations are non-refundable. Rebooking of seat reservations is possible subject to availability. In the case of rebooking to a more expensive seat, the fare difference shall be payable at the time of rebooking.

(3)  The following passengers are not permitted to sit in emergency exit rows: (a) infants and children under 14 years of age, (b) pregnant passengers, (c) persons who do not speak German and/or English, (d) persons traveling with animals in the cabin, (e) persons with physical and/or mental impairments, and (f) persons with limited mobility due to height, illness, or age.

(4)  By reserving a seat in an emergency exit row, the passenger confirms that none of the above criteria apply to them. In addition, they must be willing and able to assist the cabin crew in the event of an emergency. This requires that the passenger can follow the crew’s instructions in German or English. If this is not the case, AIR UNIQON shall be entitled to assign the passenger a different seat without any entitlement to a refund of any reservation fees. If it is not possible to assign an alternative seat despite all reasonable efforts, AIR UNIQON shall have the right to refuse carriage altogether.

(5)  A wide range of additional services may be booked with AIR UNIQON, subject to availability, such as the carriage of sports or special baggage, or meals. In the case of rebooking to a more expensive additional service, the fare difference shall be payable immediately at the time of rebooking. Rebooking or cancellation of an additional service is no longer possible within 24 hours prior to the commencement of the first flight segment.

§ 4  Ticket and Baggage

(1)  AIR UNIQON shall provide the agreed carriage only to the passenger named in the booking confirmation, ticket, or other proof of carriage, and the passenger must prove their identity with a valid identification document. Tickets and other proof of carriage are non-transferable.

(2)  When making a booking, it must be ensured that the name of the passenger, as well as any accompanying passengers, matches the spelling on the identification document presented.

(3)  If the booked fare requires a specific sequence of flight segments, AIR UNIQON reserves the right, in the event of non-utilization of a segment included in the fare, to charge the fare applicable at the time of booking for that segment if it is higher than the fare actually agreed upon. In such cases, carriage shall only be provided after payment of the difference. A claim for additional payment shall be excluded if the non-utilization occurred involuntarily and without fault, e.g., due to force majeure or illness. Any rights to partial termination under the applicable fare remain unaffected.

(4)  Depending on the selected fare, passengers may carry a certain amount of baggage free of charge. The free baggage allowance is indicated in the ticket or in the fare description forming the basis of the air transport contract. The carriage of baggage exceeding the free allowance, as well as the carriage of sports or special baggage, is subject to additional charges.

(5)  If the maximum hand baggage weight or the total baggage weight for a flight is exceeded, AIR UNIQON shall be entitled to charge for excess baggage. Fees for the carriage of excess baggage can be found on the AIR UNIQON website.

§ 5  Operating Air Carrier, Agents, Notifications

(1)  The contractual carriage services of AIR UNIQON are performed by a third party, namely the operating air carrier. The passenger will be informed of its identity in accordance with Regulation (EC) No. 2111/2005. Furthermore, AIR UNIQON is entitled to transfer the carriage, in whole or in part, to third parties or agents, in which case AIR UNIQON shall remain responsible for the carriage booked. In the event of a change to another operating air carrier, AIR UNIQON shall, irrespective of the reason for the change, take all reasonable steps without delay to ensure that the passenger is informed of the change as soon as possible. In any case, the passenger will be informed at check-in, and at the latest at boarding, in accordance with Regulation (EC) No. 2111/2005.

(2)  AIR UNIQON is entitled to amend scheduled departure and arrival times if the change is due to operational reasons that could not have been avoided even if all reasonable measures had been taken. Such operational reasons may arise in particular from necessary adjustments related to the governmental allocation of take-off and landing rights (slot allocation), operational disruptions at airports, and measures imposed by national or international aviation security or air traffic authorities.

(3)  AIR UNIQON shall inform all passengers of any changes to the flight time without delay upon becoming aware of the necessity and determination of the amended flight time.

(4)  If AIR UNIQON must modify or cancel a flight, is unable to operate a flight as scheduled, or if the performance of the flight is deficient, or if losses or damages arise due to circumstances or events beyond the control of AIR UNIQON, or which AIR UNIQON could not foresee or avoid despite exercising all reasonable care, AIR UNIQON shall not assume any compensation, damages, expenses, costs, losses, or other amounts of any kind, nor any other obligations, unless expressly stated otherwise in these GTC. Circumstances within the meaning above include, without limitation, war, serious security issues such as terrorist activities, airport or airspace closures (as well as other decisions by air traffic control that may lead to long delays, including overnight delays, or the cancellation of one or more flights), civil unrest or events arising from political instability, industrial action or strikes, fires, natural or nuclear disasters, severe weather conditions, and similar circumstances, whether they have actually occurred or merely threaten to occur.

(5)  In the event of denied boarding due to overbooking, flight cancellation, or a delay of at least two hours, passengers are entitled to rights against the operating air carrier pursuant to Regulation (EC) No. 261/2004.

§ 6  No-Show and Cancellations

(1)  The refundability of total fares and the applicable cancellation or rebooking fees in the event of a no-show, cancellation, or rebooking, as well as in cases of name changes or designation of substitute passengers, is generally determined by the fare booked.

(2)  In the event of a no-show for a booked flight, a refund of the fare, including any service charge collected at the time of booking, is excluded. Unused taxes and fees are always refundable.

(3)  Cancellations constitute the customer’s termination of the air transport contract prior to the scheduled departure. For cancellations made within 40 minutes prior to the commencement of the first flight segment, a refund of the fare, including any service charge collected at the time of booking, is excluded. Unused taxes and fees are always refundable. For cancellations made up to 40 minutes before the commencement of the first flight segment, the following provisions apply depending on the fare booked. After the outbound flight has commenced, in the event of cancellation of the return flight, a refund of the fare, including any service charge collected at the time of booking, is excluded. Unused taxes and fees are always refundable. The passenger has the right to demonstrate that AIR UNIQON has incurred no damage or a lesser amount of damage.

(4)  For passengers in Economy Class (Basic) and Premium Economy Class (Smart), in the event of cancellation only unused taxes and fees, with the exception of any service charge collected at the time of booking, will be refunded.

(5)  For passengers in Business Class, a cancellation fee of EUR 69.00 applies for cancellations made up to four (4) hours prior to the commencement of the first flight segment. In all other respects, all payments toward the total fare are refundable. Unused taxes and fees, with the exception of any service charge collected at the time of booking, are always refundable.

§ 7  Rebooking, Name Changes, and Substitute Passenger

(1)  Customer-initiated rebookings are changes relating to the date, the departure airport, or the destination airport of a flight segment previously booked by the customer. Customer-initiated rebookings are possible prior to the commencement of the flight segment to be changed, provided that rebooking is permitted under the booked fare in accordance with the following provisions, and provided that sufficient seats are available on the desired new flight in the same or a higher booking and/or fare class, and that the new flight takes place within the same season as the original flight (summer season 01 May - 31 October / winter season 01 November - 30 April). Rebooking of an originally booked return flight after commencement of the first flight segment is only possible subject to regulatory approval.

(2)  If the fare for the revised booking is equal to or lower than the fare for the original booking, the fare of the original booking shall also apply to the revised booking. Taxes and fees will be recalculated based on the revised booking. Any resulting difference is due immediately and must be settled. Unused taxes and fees are always refundable. If the fare for the revised booking is higher than the fare for the original booking, the difference between the total fare of the original booking and the total fare of the revised booking must be paid. This amount is due immediately upon rebooking. Depending on the fare selected, a rebooking fee must be paid in addition to the fare difference in accordance with the following provisions.

(3)  For passengers in Economy Class (Basic), rebooking is not permitted. For passengers in Premium Economy Class (Smart), rebooking is permitted up to twenty-one (21) days prior to the commencement of the flight segment to be changed, subject to a fee of EUR 25.00, and thereafter subject to a fee of EUR 45.00, in each case plus any applicable fare difference.

(4)  For passengers in Business Class, the first rebooking made up to four (4) hours prior to the commencement of the first flight segment is free of charge; thereafter and for any following rebooking, a fee of EUR 69.00 shall apply, in each case plus any applicable fare difference.

(5)  Changing the name of a booked passenger or designating a substitute passenger for a previously booked flight segment is possible up to 24 hours before commencement of the first flight segment only if the transportation has been booked under the Business Class fare. In the event of a name change or designation of a substitute passenger, the fare difference to any potentially higher current total fare must be paid.

§ 8  Insurance

(1)  Insurance coverage is not included in the total fare. If insurance is booked in connection with a flight reservation, the insurance provider shall be the party identified during the booking process. Any claim must be submitted directly to the insurer. AIR UNIQON is not involved in the handling and/or settlement of any such claims.

§ 9  Data Protection

(1)  In the context of concluding the air transport contract, personal data is provided to AIR UNIQON, in particular for the purpose of making flight reservations, purchasing additional services where applicable, carrying out immigration formalities, and transmitting such data to the competent authorities in connection with the operation of a flight. AIR UNIQON is authorized to forward this data, for the fulfilment of the aforementioned purposes, to its own offices, authorized agents, domestic and foreign authorities, operating air carriers, and other providers of the aforementioned services. For customer service purposes, AIR UNIQON may make use of external service providers. Their employees are subject to the same data protection obligations as AIR UNIQON.

§ 10  Final Provisions

(1)  The operating carrier acts as an agent of AIR UNIQON for the fulfilment of the obligations arising from these GTC, as well as in connection with the contractual carriage service. In this respect, AIR UNIQON shall be liable for the performance of the services undertaken by the operating carrier as if they had been provided by AIR UNIQON itself.

(2)  These GTC are governed by the laws of the Federal Republic of Germany. No agent, employee, or any other third party is authorized to alter, supplement, or waive the application of these GTC.

(3)  The exclusive place of jurisdiction for any legal action brought by air passengers who qualify as merchants within the meaning of the German Commercial Code (HGB), as well as for persons who do not have a general place of jurisdiction within the Federal Republic of Germany, and for persons who, after conclusion of the contract, relocate their residence or habitual abode to a foreign country or whose residence or habitual abode is unknown at the time the action is filed, shall be Rüthnick. This agreement on jurisdiction shall not apply to claims arising under the Montreal Convention (1999).

(4)  These GTC are published in several languages. In case of doubt, the German version shall prevail.

(5)  Should one or more provisions be invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected.

GENERAL CONDITIONS OF CARRIAGE FOR PASSENGERS AND BAGGAGE (GCC)

§ 1  Scope and Applicability

(1)  These General Conditions of Carriage (“GCC”) apply to all carriage by air of passengers and baggage, including related services, performed by AIR UNIQON GmbH (“AIR UNIQON”) for reward. They shall apply irrespective of the carrier that actually performs the contractual carriage service on behalf of AIR UNIQON.

(2)  These GCC shall also govern gratuitous or reduced-fare carriage, unless AIR UNIQON has expressly provided otherwise.

§ 2  General Carriage

(1)  AIR UNIQON provides carriage solely to the passenger named in the booking confirmation, the (electronic) flight ticket, or any other carriage document, including but not limited to the charter agreement concluded with AIR UNIQON’s customer (“Customer”). Upon request by AIR UNIQON, the passenger shall present a valid identification document to verify their identity. The passenger’s full given name and surname as stated on the applicable carriage document must correspond exactly in both spelling and sequence to the information appearing on the identification document.

(2)  The passenger shall carry all required entry, exit, transit, and health documents, including visas and any other documentation necessary for the journey and any stopovers, and shall ensure that such documents remain valid for the entire duration of the journey. The passenger shall comply with all applicable laws, regulations, requirements, and instructions of the countries flown over, to, or from which the flight operates. AIR UNIQON assumes no responsibility - and in particular no duty of verification - with respect to the validity, completeness, or sufficiency of such documents. AIR UNIQON reserves the right to refuse carriage or onward carriage if the passenger’s documentation is incomplete, invalid, or if the passenger otherwise fails to comply with applicable laws, regulations, requirements, or instructions. AIR UNIQON shall not be liable for any damage, loss, or expense arising from the passenger’s failure to comply with any such laws, regulations, requirements, or instructions.

(3)  If a passenger is denied entry into or transit through any country, the passenger shall reimburse AIR UNIQON for any damages, costs, or expenses incurred in transporting the passenger to the point of departure or to another location. In addition, the passenger shall indemnify AIR UNIQON, upon request, for any penalties, fines, or other expenses arising from such denied entry or transit.

§ 3  Check-in and Boarding Times

(1)  The applicable check-in deadline for an AIR UNIQON flight may vary by airport. For the purposes of these Conditions, the check-in deadline is defined as the time by which the passenger must have presented themselves at the relevant check-in counter. Unless otherwise specified, the passenger shall present themselves at the check-in counter no later than 90 minutes prior to the scheduled departure of each flight.

(2)  If a passenger fails to comply with the check-in deadline without any fault attributable to AIR UNIQON, AIR UNIQON shall be entitled to refuse carriage of the passenger. AIR UNIQON shall not be liable for any loss, damage, or expense incurred by the passenger as a result of such refusal of carriage.

(3)  Passengers are required to be present at the boarding gate at the time specified during check-in. Should a passenger fail to present themselves in time for boarding, AIR UNIQON shall be entitled to refuse carriage, except where such failure is attributable to AIR UNIQON or results from circumstances beyond AIR UNIQON’s control. In the event of such refusal of carriage, AIR UNIQON shall not be liable for any loss, damage, or expense incurred by the passenger.

§ 4  Carriage of Passengers

(1)  AIR UNIQON must be notified in advance of the carriage of passengers requiring special care, including details of their specific needs, as early as possible and in any event no later than 24 hours prior to the scheduled departure. If such notification is not provided or is provided too late, AIR UNIQON may be unable to provide the re-quested special care.

(2)  For safety reasons, AIR UNIQON does not carry pregnant passengers from the 36th week of pregnancy, or from the 32nd week in the case of multiple pregnancies. The relevant date shall be as indicated in the passenger’s mater-nity record, which must be carried at all times. If a return flight has been booked and the return flight falls after the thirty-sixth 36th week of pregnancy (or 32nd week for multiple pregnancies), AIR UNIQON may refuse carriage on the out-bound flight. Between the 28th and 36th week of pregnancy (or up to the 32nd week for multiple pregnancies), the passenger must present a medical certificate of fitness to fly, issued no more than 10 days prior to departure.

(3)  Each adult passenger may accompany no more than one infant, defined as a child under the age of 2 years. In the case of a child under the age of 12 years traveling with only one parent or legal guardian, a written authorization from the other parent or legal guardian, confirming consent for the child to travel with the accompanying parent or guardian, must be presented upon request.

(4)  Children may be carried in their own child safety seat on a separate passenger seat. The child safety seat must be secured at all times during the flight using the seat belt provided on the aircraft seat. The child safety seat must be suitable for use on board an aircraft. Otherwise, AIR UNIQON shall be entitled to refuse carriage of the child safety seat in the cabin. AIR UNIQON shall not be liable for any consequences arising from improper securing of the child safety seat, malfunction of the seat, or failure to comply with the instructions provided.

(5)  Children under the age of 5 years may only travel when accompanied by an adult aged at least 18 years, or together with siblings aged 16 years or older. The carriage of unaccompanied children aged 5 to 12 years must be registered with AIR UNIQON at least 48 hours prior to the scheduled departure. At the departure airport, complete details (name, address, telephone number) of the accompanying person delivering or collecting the unaccompanied child must be provided until the child is handed over or received. If this person is not a legal guardian, a written authorization from the legal guardian granting permission for check-in and collection of the child must be presented. For safety reasons, the accompanying person must present valid photo identification at check-in and upon handing over the child at the destination. To the extent permitted by the relevant airport authorities, the child must be accompanied by the designated person up to the boarding gate. The accompanying person is required to remain at the airport until the actual departure of the aircraft. On board, care for the child will be provided by personnel. Unaccompanied adolescents up to 16 years of age may, upon explicit parental request, be treated as unaccompanied minors.

(6)  AIR UNIQON shall be entitled to refuse carriage or onward carriage to a passenger if:

(a)  such refusal is necessary for reasons of safety and good order, or to avoid violation of legal or official requirements of the country of departure, overflight, or arrival;

(b)  carriage of the passenger may adversely affect the safety, health, or, to a material extent, the well-being of other passengers or crew members;

(c)  the passenger’s behavior, condition, or mental or physical state, including the in-fluence of alcohol or drugs, poses a risk to themselves, other passengers, or crew members;

(d)  the passenger has behaved in a disruptive or non-compliant manner on a previous flight of AIR UNIQON or the operating carrier and there is reason to believe such behavior will be repeated;

(e)  the passenger refuses to undergo a required security check;

(f)  the passenger is not in possession of the required travel documents, seeks to enter a country for which only transit is permitted, lacks valid entry documents, destroys travel documents during the flight, or refuses to surrender such documents to the crew upon request and receipt;

(g)  the passenger presents a booking confirmation, ticket, or other transport document obtained illegally, reported lost or stolen, forged, or fails to identify themselves as the person entitled to be carried;

(h)  the passenger does not comply, or does not fully comply, with safety regulations or instructions;

(i)  the passenger disregards smoking bans or restrictions on the use of electronic de-vices during boarding or on board the aircraft.

(7)  If a passenger is refused carriage for any of the reasons set out above, AIR UNIQON shall not be liable for any resulting damage, loss, or expenses.

§ 5  Carriage of Baggage

(1)  Passengers may carry a certain amount of baggage in the cargo hold as checked baggage free of charge. The specific details are set out in the applicable booking confirmation. Carriage of baggage exceeding the applicable free baggage allowance, as well as the carriage of special or sports equipment, is subject to an additional charge.

(2)  AIR UNIQON reserves the right to refuse carriage or onward carriage of baggage if it is unsuitable due to size, shape, weight, type, or content, or for reasons of safety or the well-being of other passengers or crew members. AIR UNIQON may also refuse carriage or onward carriage of baggage if it is not properly packed in suitcases or similar containers to ensure safe transport with ordinary care in handling.

(3)  Passengers shall not include in their baggage:

(a)  items likely to endanger the aircraft or persons or property on board, including, but not limited to, explosives, compressed gases, oxidizing, radioactive, magnetizing, highly flammable, toxic, or corrosive substances, as specified in the ICAO Technical Instructions for the Safe Transport of Dangerous Goods by Air and the IATA Dangerous Goods Regulations;

(b)  items the carriage of which is prohibited by applicable laws, regulations, or orders of any state of departure, arrival, or overflight;

(c)  items unsuitable for carriage due to weight, size, or nature, such as fragile or perishable goods;

(d)  individual lithium batteries or accumulators (commonly used in power banks, laptops, mobile phones, cameras, watches, etc.), which must be carried in hand luggage only. A maximum of two batteries or accumulators with a watt-hour rating between 100Wh and 160Wh may be transported, subject to prior approval, and must be protected against damage or short circuits;

(e)  cash, jewelry, precious metals, cameras, mobile phones, electronic devices (e.g., laptops or notebooks), delicate optical instruments, business papers, samples, valuable works of art with a market value exceeding EUR 300, perishable and fragile items, passports and other identification documents, urgently required medications, as well as valuables with a replacement value exceeding EUR 300, unless they are intended as clothing. AIR UNIQON shall not be liable for damage to or loss of items that are unlawfully included in checked baggage in violation of these provisions, in accordance with Art. 20 of the Montreal Convention (1999). This also applies to consequential and indirect damages resulting from the carriage of such items in checked baggage.

(4)  Passengers are solely responsible for paying any customs duties, taxes, or other charges arising in connection with their baggage.

(5)  Passengers carrying weapons of any kind - whether in hand luggage or on their person - including, but not limited to (a) firearms, blunt or sharp weapons, and sprays usable for attack or defense, (b) ammunition and explosive substances, (c) objects that, due to appearance or markings, give the impression of being weapons, ammunition, or explosive substances must notify AIR UNIQON prior to the start of the journey. Carriage of such items is permitted only as checked baggage in accordance with regulations governing the carriage of dangerous goods. Weapons must be handed over to the Pilot-in-Command during the flight.

(6)  Hunting and sporting weapons may be accepted as checked baggage at the discretion of AIR UNIQON. Such weapons must be unloaded and secured with a locked safety device. The carriage of ammunition is subject to the aforementioned regulations of ICAO and IATA.

(7)  AIR UNIQON shall not be liable for any items contained in checked baggage in violation of the provisions above. AIR UNIQON reserves the right to refuse carriage or onward carriage of such items

(8)  For security reasons, AIR UNIQON may require passengers to submit to a search or X-ray of their person and/or baggage. Passengers who refuse such security measures aimed at detecting items prohibited from carriage may be refused carriage or onward carriage of themselves or their baggage. AIR UNIQON shall not be liable for any damage, loss, or expenses resulting from such refusal or the application of security measures.

(9)  The carriage of sports equipment and other special baggage must be notified to AIR UNIQON no later than 24 hours prior to the scheduled departure. In the absence of such notification, or if it is made late, carriage cannot be guaranteed. No notification is required for the carriage of strollers, buggies, travel cots, or sunshades.

(10)  Die Beförderung von Sport- und Sondergepäck ist nur in dafür geeigneten Transportverpackungen bzw. Transportbehältnissen möglich. Im Falle der nicht ordnungsgemäßen Verpackung behält sich AIR UNIQON das Recht vor, eine Beförderung abzulehnen. Jegliches Sport- oder Sondergepäck muss separat, d.h. getrennt vom aufgegebenen Reisegepäck, verpackt und aufgegeben werden. Anderenfalls wird das gesamte Gepäck zu den aktuellen Übergepäckgebühren abgerechnet, welche möglicherweise höher als die Pauschalgebühr für Sport- und Sondergepäck sind. In aufgegebenem Sportgepäck dürfen keine anderen Gegenstände enthalten sein als diejenigen, die unmittelbar zur Ausübung des Sports erforderlich sind, insbesondere keine Bekleidung. Aufgrund des erhöhten Zeitaufwandes bei der Abfertigung von Sport- und Sondergepäck sollten Fluggäste spätestens 120 Minuten vor dem planmäßigen Abflug am Abfertigungsschalter erscheinen.

(11)  Upon delivery of checked baggage, AIR UNIQON assumes custody of the baggage. AIR UNIQON shall make an entry in the passenger ticket, which constitutes the issuance of the baggage receipt. If a baggage tag is additionally issued, it serves solely to identify the baggage. Checked baggage shall be transported on the same aircraft as the passenger, unless safety or operational reasons necessitate its carriage on another flight (preferably the next available flight). If checked baggage is carried on a subsequent flight, it shall be delivered to the passenger’s location, unless the passenger’s presence is required for customs inspection. The provisions relating to liability for damage remain unaffected.

(12)  Items that are not suitable for carriage in the cargo hold (e.g., delicate musical instruments) shall be accepted for carriage in the cabin only if they are notified to AIR UNIQON by the passenger at least 24 hours prior to departure and accepted by AIR UNIQON for carriage. Such carriage is subject to an additional charge.

(13)  In addition to the free baggage allowance pursuant to § 5 (1), passengers may carry hand baggage in the cabin if and to the extent such allowance is included in their booking. AIR UNIQON may establish limits on the number, maximum weight, and dimensions of hand baggage. In all cases, hand baggage must fit under the seat in front of the passenger or in the overhead compartments. Baggage that does not meet these requirements or fails to comply with applicable safety regulations must be transported as checked baggage. In such cases, additional charges shall apply.

(14)  Hand baggage must not contain pointed or sharp objects, such as knives, scissors, or items from a manicure set. In accordance with Regulation (EC) No. 1546/2006, passengers on all flights departing from Europe may carry liquids, pressurized containers (e.g., sprays), pastes, lotions, and other gel-like substances in hand baggage only in containers with a maximum volume of 100 ml each. The volume indicated on the container, not the fill level, is decisive. All individual containers must fit entirely within a single resealable, transparent plastic bag with a maximum capacity of 1 liter and will be inspected at security control. Only one such bag is permitted per passenger. Special provisions apply to medication and baby food. Various non-EU countries have adopted similar or equivalent regulations. AIR UNIQON shall not be liable for any damage or expenses incurred by passengers as a result of non-compliance with these regulations during airport security control.

(15)  The carriage of baggage exceeding the free baggage allowance is subject to a charge. The carriage of special baggage is likewise subject to a charge. The currently applicable fees of AIR UNIQON, as relevant to the individual case, shall apply.

§ 6  Carriage of Animals

(1)  The carriage of dogs, cats, and other pets is subject to prior approval by AIR UNIQON. In this regard, the provisions of the IATA Live Animals Regulations (IATA LAR) as well as applicable international and national animal welfare laws shall apply. AIR UNIQON reserves the right to determine the method of carriage and to limit the number of animals permitted on any flight. Unless otherwise provided in the following regulations, the carriage of animals is subject to a charge.

(2)  The carriage of animals with shortened skulls (‘brachycephalic’ or ‘snub-nosed’ breeds) is generally prohibited due to the risk posed to them under stress.

(3)  Animals must be properly housed in transport containers approved for air carriage and be accompanied by valid health and vaccination certificates, as well as entry, exit, and transit permits and any other documents required by the respective countries.

(4)  The weight of the animals, their transport containers, and any accompanying pet food is not included in the passenger’s free baggage allowance. Charges shall apply for their carriage.

(5)  A service dog required by the passenger (such as guide dogs, therapy dogs, and comparable assistance dogs) shall be transported free of charge and, where possible, in the cabin. Free carriage and transport are subject to proof of the medical necessity for the passenger. AIR UNIQON must be informed of such transport as early as possible, and in any case no later than 48 hours prior to departure. The passenger assumes full responsibility for the safety, health, welfare, and behavior of the animal. This also applies to any interaction with other passengers and crew members while the animal is on board the aircraft or during boarding and disembarkation.

(6)  Condition for the carriage of an animal is that it is trained to behave appropriately in a public environment. Cabin carriage is permitted only on the condition that the animal is obedient. Otherwise, it may be necessary to require the use of a muzzle for transport, to place the animal in the cargo hold (if a suitable transport container is available), or to refuse carriage. Animals traveling in the cabin, together with their transport container, must fit within the passenger’s foot space and remain properly secured for the duration of the flight.

(7)  The passenger is responsible for the safety, health, and behavior of their animal and bears sole responsibility for compliance with all applicable laws, regulations, and requirements of the country from which and/or to which the animal is transported and/or in which any of the passenger’s stopovers occur. This includes, in particular, the provision of required health certificates, permits, and vaccinations. The passenger’s liability also covers all costs or consequences arising from non-compliance with such laws, regulations, and requirements, which may include the quarantine of the animal upon arrival. To this extent, the passenger shall indemnify AIR UNIQON against any liability.

§ 7  Behaviour on Board

(1)  The Pilot-in-Command is authorized to take any measures deemed necessary to ensure the safety and security of the flight, passengers, crew, and aircraft at any time. For safety reasons, all passengers are required to comply fully and without delay with the instructions of the Pilot-in-Command and crew members.

(2)  If the conduct of a passenger on board an aircraft endangers the aircraft or any person or property on board, interferes with the duties of the crew, disobeys crew instructions - including those regarding smoking, consumption of alcohol or drugs - or otherwise causes discomfort, damage, or injury to other passengers or crew members, AIR UNIQON may take all measures reasonably necessary to prevent or stop such conduct, including physical restraint, if required. In such cases, AIR UNIQON reserves the right to disembark the passenger at any location and to pursue criminal or civil proceedings against the passenger.

(3)  For safety reasons, the use of privately owned electronic devices equipped with a transmitter or receiver unit (e.g. laptops, tablets, e-books, or mobile phones) is only permitted during flight if flight mode is activated or all transmitting and receiving functions have been fully disabled. Bluetooth accessories (e.g. wireless keyboards, headphones) may be used only during the flight phase, but not during take-off or landing. The use of any electronic devices is strictly prohibited during safety demonstrations or whenever instructed by the crew.

(4)  All AIR UNIQON flights are non-smoking flights. Smoking is prohibited in all areas of the aircraft. This includes electronic cigarettes, regardless of whether they contain psychoactive substances. The consumption of alcoholic beverages brought on board by passengers is not permitted.

(5)  For the passenger’s own safety and in the interest of flight safety, AIR UNIQON must be informed of any allergies to specific foods or ingredients no later than 48 hours prior to departure. AIR UNIQON cannot guarantee that the passenger will not be exposed to allergens on board. There is no obligation to transport a passenger who has an allergy that poses a significant risk to their health if it is not possible to guarantee the absence of the relevant food or ingredient on board, in meals, or in the cabin air.

(6)  Passengers are required to remain seated throughout the flight whenever the seat belt signs are illuminated. Seat belts must be fastened at all times while seated for safety reasons.

(7)  Filming and photography on board are permitted only if it is ensured that the rights - particularly the personal rights - of the persons being recorded are respected. At the crew’s instruction, filming and photography on board may be prohibited at any time.

§ 8  Liability and Time Limitations

(1)  Carriage is subject to the liability regime established by the Montreal Convention of 28 March 1999, as implemented in the European Union by Regulation (EC) No. 889/2002 (“Montreal Convention”) and the national legislation of the Member States. The Montreal Convention governs and limits AIR UNIQON’s liability in cases of death or personal injury of passengers, loss of or damage to baggage, and delay.

(2)  If the damage was caused by the fault of the injured party, the provisions of the applicable law concerning the exclusion or reduction of AIR UNIQON’s obligation to pay compensation in the event of contributory fault on the part of the injured party shall apply.

(3)  Legal actions for damages under the Montreal Convention must be brought within 2 years from the date of arrival of the aircraft, the date on which the aircraft should have arrived, or the date on which the carriage was cancelled. The calculation of this period shall be determined in accordance with the law of the competent court.

(4)  AIR UNIQON shall not be liable for any damage resulting from the fulfilment of governmental regulations by AIR UNIQON or from the failure of passengers to comply with the obligations arising therefrom.

(5)  Under no circumstances shall AIR UNIQON’s liability exceed the amount of the proven damage. AIR UNIQON shall be liable for indirect or consequential damage only if such damage was caused intentionally or by gross negligence. This limitation does not apply to personal injury.

(6)  The liability exclusions and limitations under the Montreal Convention and applicable national law shall apply, unless expressly stated otherwise in these GCC.

(7)  There are no maximum liability limits for claims arising from death or personal injury of passengers. For damages up to 151,880 Special Drawing Rights (SDR) (approx. EUR 190,000), AIR UNIQON may not raise any defenses based on fault. For claims exceeding this amount, AIR UNIQON may avoid liability by proving that neither AIR UNIQON nor its vicarious agents acted negligently or otherwise culpably, and that no negligent or otherwise culpable act or omission caused the damage.

(8)  If a passenger is killed or injured, AIR UNIQON shall make an advance payment within 15 days of identifying the person entitled to compensation to cover immediate economic needs. In the event of death, the advance payment shall be no less than 16,000 SDR (approx. EUR 21,000).

(9)  No-fault liability applies to checked baggage unless the baggage was already damaged prior to check-in. In the case of unchecked baggage, AIR UNIQON shall be liable only for damage resulting from intentional or negligent conduct.

(10)  AIR UNIQON shall be liable for destruction, loss, or damage to checked baggage up to 1,519 SDR (approx. EUR 1,900). A higher limit of liability applies if the passenger makes a special declaration at check-in, no later than the time of check-in, stating the value of the checked baggage and subject to the payment of a surcharge. In such cases, the declared amount shall constitute the liability limit, unless AIR UNIQON can prove that the declared value exceeds the passenger’s actual interest in the delivery of the checked baggage at the destination.

(11)  If a passenger accepts checked baggage unconditionally, it shall be presumed, unless proven otherwise, that the baggage was delivered in good condition. In the event of damage, loss, or destruction of baggage, the passenger must notify AIR UNIQON in writing or in text form as soon as possible. For checked baggage, any legal action is barred if the damage is not reported to AIR UNIQON no later than 7 days after acceptance, and in the case of other baggage, immediately upon discovery of the damage. This shall not apply if AIR UNIQON has acted fraudulently.

(12)  AIR UNIQON shall not be liable for damage caused by items in checked baggage unless such damage results from gross negligence or wilful misconduct by AIR UNIQON. If these items cause damage to the baggage of another passenger or to AIR UNIQON’s property, the passenger shall be liable to compensate AIR UNIQON for all resulting damage and expenses.

(13)  AIR UNIQON shall be liable for damage caused by delays in the carriage of passengers and checked baggage, unless AIR UNIQON and its vicarious agents have taken all reasonable measures to prevent such damage, or it was impossible to take such measures.

(14)  Liability for damage caused by delays in the carriage of passengers is limited to 6,303 SDR (approx. EUR 7,900).

(15)  Liability for damage caused by delay in the carriage of baggage is limited to 1,519 SDR (approx. EUR 1,900). A higher limit applies if the passenger makes a special declaration at check-in, no later than the time of check-in, stating the value of the checked baggage and subject to the payment of a surcharge. In such cases, the declared amount constitutes the liability limit, unless AIR UNIQON can prove that the declared value exceeds the passenger’s actual interest in the delivery of the checked baggage at the destination.

(16)  In the event of damage caused by delayed delivery of baggage, the passenger must notify AIR UNIQON in writing or in text form as soon as possible. Any legal action for such damage is barred if the passenger does not report the damage within 21 (twenty-one) days of baggage delivery. This shall not apply if AIR UNIQON has acted fraudulently.

(17)  If the aggrieved party was at fault for the damage, the amount of any claim for damages shall be reduced in proportion to the contributory negligence of the aggrieved party. In particular, the passenger is obliged not to exacerbate the damage caused by loss or delayed delivery of baggage through unreasonable replacement purchases.

§ 9  Data Protection

(1)  AIR UNIQON collects, processes, and uses personal data to the extent necessary for the conclusion, performance, or termination of the carriage contract and any ancillary ser-vices related thereto. Such data is collected, processed, and used within the scope of the contractual purpose through appropriate data processing systems and in compliance with applicable legal provisions. This includes, in particular, making reservations, issuing flight tickets, providing additional services, processing payments, and facilitating entry and customs clearance procedures. In this context, AIR UNIQON may transmit data to third parties who are contractual partners of AIR UNIQON, insofar as such transmission is necessary to fulfil the purposes described above.

(2)  If and to the extent required by law or by regulatory authorities, AIR UNIQON collects passport data and submits such data to authorities in Germany and abroad. The same applies to other personal data collected, processed, or used in connection with the carriage contract, provided that the transmission is mandated by applicable statutory pro-visions and is necessary for the performance of the contract of carriage.

§ 10  Final Provisions

(1)  The operating carrier acts as an agent of AIR UNIQON for the fulfilment of the obligations arising from these GCC, as well as in connection with the contractual carriage service. In this respect, AIR UNIQON shall be liable for the performance of the services undertaken by the operating carrier as if they had been provided by AIR UNIQON itself.

(2)  These GCC are governed by the laws of the Federal Republic of Germany. No agent, employee, or any other third party is authorized to alter, supplement, or waive the application of these Conditions of Carriage.

(3)  The exclusive place of jurisdiction for any legal action brought by air passengers who qualify as merchants within the meaning of the German Commercial Code (HGB), as well as for persons who do not have a general place of jurisdiction within the Federal Republic of Germany, and for persons who, after conclusion of the contract, relocate their residence or habitual abode to a foreign country or whose residence or habitual abode is unknown at the time the action is filed, shall be Rüthnick. This agreement on jurisdiction shall not apply to claims arising under the Montreal Convention (1999).

(4)  These GCC are published in several languages. In case of doubt, the German version shall prevail.

(5)  Should one or more provisions be invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected.
